Patent Infringement Litigation
The Project
LawyerLink worked with a leading global producer of specialty chemicals and polymer products, and its law firm, to complete discovery for a large litigation defending complex bifurcated patent infringement and breach of contract claims of a major international competitor.
Challenges Met
- This litigation required a multifaceted review, coding for both patent and contract aspects and redacting separately for privilege, contract relevance and patent relevance.
- The case required eReviewers with knowledge of advanced organic chemistry, as chemical formulas and processes formed the basis of the dispute.
- Our team reviewed 13 years of research and discovery contained in handwritten lab notebooks.
- The project required proficiency in two software programs (Summation, to review and code scanned paper documents; and Prevail, to review and code electronic files).
High Performance Delivered
- LawyerLink assisted from data collection through depositions and trial.
- Our 100% team member retention throughout the project allowed for continuity of work product and case knowledge and efficient use of individual talents.
- To control costs, the project began with two attorneys performing data collection and early review, expanded to six attorneys for the bulk of eReview, and returned to two attorneys for deposition and trial assistance.
- When certain spreadsheet documents required time consuming redactions, our project manager immediately consulted with outside counsel to develop alternative processes saving hundreds of hours of costly work.
- When faced with software challenges and vendor delays, our team devised a manual production plan that led to the production of all relevant documents ahead of schedule.
UPDATE: One of LawyerLink’s eReviewers has remained dedicated to this client’s patent litigations for the last three years.
